Hertfordshire Police Face Criticism for Wrongful Arrest and Lack of Accountability in Mistreatment Case

In a shocking incident at a police station in Watford, Hertfordshire, a visitor was falsely accused of drink driving by a front counter officer (8622) .

A man named Mr. Usher visited a police station in Watford to collect some items. However, a desk clerk (8622) reported him for drink driving, claiming she could smell alcohol on him.

The police then forcefully arrested him, and repeatedly asked him to blow into a breathalyzer.

However, Mr. Usher declined to take the test, citing mental health grounds as a reasonable excuse.

A reasonable excuse can be a genuine physical or mental condition stopping someone from giving a sample.

He informed the officers of his mental health issue, but they did not act on it.

Mr. Usher then informed the officers that he did not consent to the arrest and that he would charge them £1000 in gold under common law for unlawful arrest.

The officers did not check the legislation and instead insisted on arresting him for failing to provide a breath sample.

The two officers (Heaney and Hopkins) then forced the mans arms from behind his back and restrained him in handcuffs and took him to Hatfield Custody Station.

At Hatfield, Mr. Usher was arrested for driving under the influence of alcohol.

However, two breath samples were taken, and both showed that there was no alcohol in his system, meaning that he was not guilty of the suspected offence. He was then released.

Later, a complaint was made to the Police Conduct Authority Professional Standards Department, but the investigation report was not satisfactory, and there was no accountability.

Mr. Usher's first appeal was also met with a rude warning for harassment.

To summarize, Mr. Usher was wrongfully accused of drink driving, arrested, and restrained by force, even though he had a reasonable excuse for not taking the breath test. He was later found to be not guilty of the suspected offence.

The investigation into the matter was insufficient, and there was no accountability.

Despite Mr. Usher's insistence that he was suffering and that his actions were under duress, the officer refused to consider his mental health concerns and threatened him with arrest for failing to provide a sample.

Mr. Usher exercised his legal right to refuse the test and informed the officers that he did not consent to the arrest.

his is a serious breach of protocol, as the police have a duty of care to those in their custody, especially those with pre-existing health conditions.

It is important that the police receive proper training on how to handle individuals with mental health issues to prevent similar incidents from occurring in the future.

 

Deputy Chief Constable Michelle Dunn said: “There is no place in Hertfordshire Constabulary for those who exploit vulnerable people, especially when we should be there to protect and support them.”

Sergeant Cooper (939) made himself present during the arrest, who had already been found to use inappropriate force when he assaulted the same man back in 2012. It could be that this was some attempt at revenge.

 

A driver with mental health was falsely arrested for driving under the influence of alchohol was given no support even though police were told of the mans condition. A predator police officer made false allegations and it turned out he was only Chewing gum.

Injuries were left his wrists red and marked from the incident.

 

Upon being signed in at Hatfield, a further arrest was made for driving under the influence of alcohol.

 

He gave two breath samples, and both times found to contain ZERO alcohol and thus not guilty of suspected offence and was released and Free to go on his lawful way.

 

A complaint was made to Police Conduct Authority Professional Standards Department, but the Investigation report is a damage limitation excercise and not accountability. There are serveral blunders and upon his first appeal he was rudely warned for harrassment upon a first appeal.

 

Unlawful Arrest If arrested under anything other than a common law offence, and from the moment of any such arrest, handcuffing, transportation, incarceration or subjection to any adjudication process without my express written and notarised consent.

Mr. Usher's wrongful arrest is a reminder that even front counter officers should exercise caution and not jump to conclusions based on assumptions or incomplete evidence.
